U.S. Immigration Agency to Implement New Version of Form I-485, Clarifying “Public Charge”

The U.S. Citizenship and Immigration Services (USCIS), also known as the Immigration Agency, announced on Wednesday, August 19, that they will be releasing a revised version of the “Application for Adjustment of Status” form (Form I-485) on September 18, 2026.

This revision of the form is aimed at aligning with the “Public Charge Ground of Inadmissibility Final Rule” announced on July 20. The new version of the Form I-485 will replace the version from January 20, 2025.

As there is no grace period for the revised Form I-485, the Immigration Agency is set to provide a preview of the Form I-485 and its instructions for the September 18, 2026 version.

Applicants are advised not to submit the new Form I-485 before September 18, 2026. The Immigration Agency will only accept forms with a postmark or electronic submission date on or after September 18, 2026.

Here are some key points for applicants to note when submitting the Form I-485:

– If the Form I-485 from January 20, 2025, has a postmark or is electronically submitted before September 18, 2026, the Immigration Agency will accept that version.
– If the Form I-485 from January 20, 2025, has a postmark or electronic submission date on or after September 18, 2026, it will be rejected.
– The Immigration Agency will only accept the September 18, 2026 version of the Form I-485 with a postmark or electronic submission date on or after that date.
