China University of Political Science and Law Faculty and Students Accused of Plagiarism in Collaborative Paper

Recently, a post-doctoral scholar in law at the Chinese Academy of Social Sciences, Jiao, was exposed by several users on Xiaohongshu (Little Red Book) for suspected plagiarism in a paper published in the journal “Study and Exploration” during his doctoral studies.

According to reports by Li Zhi News, the paper titled “Criminal Responsibility of Autonomous Driving Programmers – An Analysis Centered on the Criminal Justification of ‘Difficult Circumstances’,” with Jiao as the first author and Professor Xu Jiusheng from the China University of Political Science and Law as the second author, was accused of heavily plagiarizing a paper by Japanese scholar Taku Hiroshi titled “Legal Issues Surrounding Programming of Fully Autonomous Driving Vehicles – Focusing on the So-Called Dilemma Situation.” It is claimed that the structure of the article, core viewpoints, and even some paragraphs are strikingly similar to the Japanese paper, with some parts even directly translated from Japanese to Chinese.

Moreover, Jiao was also accused of plagiarizing a master’s thesis titled “Reconstructing the Judgment Standard of Legitimate Defense from the Principle of Personal Protection,” which allegedly copied from a work by Professor Hsu Heng-ta at National Taiwan University with a similar title discussing the reconstruction of legitimate defense from the principle of personal protection. Additionally, his legal core article “Criminal Responsibility in Traffic Accidents of Semi-Autonomous Vehicles” was said to have plagiarized a paper by Associate Professor Chen Junwei from National Chung Hsing University in Taiwan on “Criminal Liability for Driving Semi-Autonomous Vehicles in Traffic Accidents.”

On April 14th, the Chinese Academy of Social Sciences University announced that all work related to Jiao at the post-doctoral mobile station has been suspended, and an investigation procedure has been initiated in compliance with regulations. Currently, Jiao’s resume has been removed from the official website of the Law School at the Chinese Academy of Social Sciences University, and related information is no longer available.

Following this, on April 15th, the China University of Political Science and Law reported that an investigation team has been established and an investigation procedure has been launched regarding allegations of plagiarism in academic papers jointly published by Jiao and his supervisor Xu in the class of 2023 doctoral graduates.
