Hollywood Mogul Harvey Weinstein Sexual Assault Case, Prosecutors Recommend Retrial in September

Former Hollywood mogul Harvey Weinstein’s conviction for sexual assault was overturned by the New York State Supreme Court – Court of Appeals last week. On May 1st, a retrial hearing was held at the Manhattan Criminal Court, with the prosecution expressing the desire to proceed with the retrial as soon as September.

Weinstein appeared in court that day in a wheelchair and handcuffs, making his first public appearance since the conviction was overturned. One of his accusers, Jessica Mann, was also present in court, while the other accuser, Miriam Haley, did not attend.

Manhattan District Attorney’s Office prosecutor Nicole Blumberg informed Judge Curtis Farber, who is overseeing the retrial, that Mann is prepared to testify again and suggested scheduling the retrial date after Labor Day. Blumberg emphasized the prosecution’s eagerness for a swift retrial and expressed confidence that Weinstein would be convicted again.

Weinstein’s lawyer, Arthur Aidala, stated that Weinstein is eager to prove his innocence, indicating that the new trial will bring fresh perspectives to the case.

At the age of 72, Weinstein was sentenced to 23 years in prison in 2020 for the alleged rape of former production assistant Haley and the sexual assault of actress Mann. However, on April 25, the New York State Court of Appeals overturned the conviction due to the appearance of a witness unrelated to the case allowed by the trial judge, deeming it unfair to the defendant and ordering a retrial. Since the conviction was overturned, Weinstein has been transferred from upstate prison to the city’s jail system. However, due to his heart disease and diabetes, he is currently receiving treatment at Bellevue Hospital. Even if New York State does not proceed with a retrial, Weinstein will not be released as he is also serving a 16-year sentence in California for another rape case.
