A Visiting exile from Heilongjiang Province, Xiao Shujun, has been wrongly sentenced to a prison term of three years and six months, and was imprisoned at the Shuangyashan Prison in Heilongjiang Province on November 27th (formerly known as the Bijiashan Prison). This is a prison that detains serious criminals, causing great fear to Xiao Shujun, who suffers from severe heart disease and paralysis.
Prior to being sent to prison, Xiao Shujun’s health had already deteriorated in the detention center. His lawyer and family had applied for medical parole multiple times but were all denied. Family member Xia Beibei told a reporter from Epoch Times that the conditions at Shuangyashan Prison are evidently not suitable for Xiao Shujun’s physical condition, and they do not understand why the authorities made this arrangement.
Xia Beibei said, “Xiao Shujun’s case has been repeatedly denied the release on medical parole rulings by Tongjiang Court in the first trial and the Jiamusi Intermediate Court in the second trial, only citing ‘oral responses’ as a way to evade legal responsibility. This approach blatantly violates Article 304 of the Criminal Procedure Law, which mandates the preparation of written rulings and their delivery, and constitutes a serious procedural violation.”
On November 26th, family members met with Xiao Shujun at the Tongjiang City detention center. Xiao Shujun told his family that someone in the detention center had informed him: “Shuangyashan Prison is extremely harsh! Your physical condition is completely unsuitable for incarceration, the government is forcibly imprisoning you out of fear of your appeals. They are even harsher on petitioners inside the prison, finding ways to deal with you. Every prison has a death quota, and it is very common for petitioners to die inside.”
He also expressed his extreme fear of being sent to Shuangyashan Prison and hoped that the public would continue to pay attention to his and his wife Yin Dengzhen’s safety, who is involved in the same case.
According to Xiao Shujun, on May 14, 2021, he was violently beaten to paralysis during a rights protection appeal at the Supreme People’s Court in Beijing by more than thirty judicial policemen led by former chief of the court police force, Li Fengwei (badge number: 010026).
Regarding the paralysis caused by the violent beating from the judicial police of the Supreme People’s Court, Xiao Shujun filed a lawsuit, but the Chaoyang Police in Beijing claimed that the level of the judicial police was too high for them to handle, so they refused to register the case. Seeking justice, the paralyzed Xiao Shujun and his wife, Yin Dengzhen, were forced to lay on the road across from the Supreme People’s Court for a month.
As the case progressed to the Jiamusi Intermediate Court, in the ruling of the case where Xiao Shujun was paralyzed by the Supreme People’s Court judicial police, the court denied the illegal actions of the judicial police of the Supreme People’s Court, instead accusing Xiao Shujun of making a “fabricated” alarm call to 110 for help, and calling 12345 to make a “malicious complaint”, severely disrupting social order.
On June 29, 2023, Xiao Shujun and Yin Dengzhen once again came to the road across from the Supreme People’s Court to protect their rights, where they were violently attacked by several security guards from the Supreme People’s Court, resulting in Yin Dengzhen’s broken ribs and multiple injuries all over her body; Xiao Shujun was pushed to the middle of the road, narrowly avoiding being run over by a bus, and later fainted due to an epileptic seizure. Both were then rushed to the emergency room for treatment. The security guards were fully armed during the assault, even wearing steel wire gloves.
Xiao Shujun and Yin Dengzhen once again took the Supreme People’s Court to court for these actions. In the first trial, the Tongjiang City Court did not adopt the solid evidence provided by the lawyers. In the verdict, the Tongjiang City Court stated that Xiao Shujun and Yin Dengzhen “bit the law enforcement officers”. In the second trial at the Jiamusi Intermediate Court, the false evidence provided by the Registration Department of the Supreme People’s Court was accepted.
The situation did not end there. On January 26, 2025, six unidentified individuals illegally entered Yin Dengzhen’s home in Beijing, kidnapped her, and took her back to Shiyan City in Hubei Province. At the same time, a delegation from Tongjiang City government came to Beijing and demanded that Xiao Shujun must leave by February 8th. Xiao Shujun was charged with the crime of “defaming the police and falsely accusing Li Fengwei of the Supreme People’s Court” for posting distress messages in a WeChat group.
Yin Dengzhen was abducted and taken back to Shiyan City, while Xiao Shujun was brought back to Tongjiang City. The couple was detained on charges of “assaulting the police” and later sentenced to four years and six months for Yin Dengzhen and three years and six months for Xiao Shujun on suspicion of “provoking trouble”.
Family member Xia Beibei stated, “Up to now, the judiciary has not only refused to issue rulings on medical parole in accordance with the law but has also seriously distorted the facts in multiple legal documents, covering up incidents of violent beatings leading to paralysis, illegal seizure of land (original petition events), and more. Xiao Shujun and Yin Dengzhen are facing continuous deterioration of their health and life-threatening situations while in prison.
Exiled in Japan, Xia Beibei insists on live streaming in front of the Chinese embassy in Japan every week, exposing the Director of the Registration Department of the Supreme People’s Court, Qian Xiaochen, for fabricating false evidence and maliciously concocting the “assaulting the police” charge against Xiao Shujun. This case is similar in nature to over a dozen other cases of criminal persecution against visiting exiles.
She said she is not only speaking out for her parents for help but also advocating for other petitioners who are being persecuted and kept in prisons.
