Taiwanese Prohibited from Serving in Chinese Communist Party, Government, and Military Positions to Prevent Infiltration by Red Elements.

The Mainland Affairs Council of the Republic of China has amended the announcement prohibiting Taiwanese from holding positions in the Chinese Communist Party (CCP) government and military. The amendment, effective today (May 2nd), was released by the Mainland Affairs Council to adjust to the current structure of the CCP government and military system, clearly defining the scope of related organizations to accurately correspond to the actual situation, and prevent the infiltration and division by the CCP in Taiwan, ensuring the security and stability of Taiwan.

The Mainland Affairs Council issued a press release today regarding the amendment of the “Prohibition of Taiwanese people, legal entities, organizations, or other institutions from holding positions in the CCP party, military, administrative or political organizations or being members of these organizations” appendix.

According to the Mainland Affairs Council, the amendment of Article 33, Paragraph 2 of the Act Governing Relations between the People of the Taiwan Area and the Mainland Area in 2003 stipulates that nationals cannot hold positions in the CCP government or military organizations that have been prohibited by various competent authorities through consultations with the Council or be members of such organizations. Violators will be punished according to Article 90 of the same law and the prohibition announcement was issued in 2004. Given the major organizational adjustments made by the CCP in recent years, the prohibition announcement has not been revised for over 20 years since its issuance in 2004, making it difficult to accurately correspond to the current structure of the CCP government and military organizations. Therefore, the Council, in consultation with various competent authorities, has promoted the amendment of the prohibition announcement appendix and completed the related legal procedures, which was approved by the Executive Yuan.

The key points of this amendment are as follows:

1. Adjusting the structure of the CCP party, military, and administrative organizations according to their current framework, and clearly defining the scope of related organizations.

2. Adding examples of political organizations and groups (such as the Association for Relations Across the Taiwan Straits, the Chinese Association for Promoting National Reunification, the All-China Youth Federation, and Confucius Institutes) and including their affiliated organizations, business units, groups, offices, branch organizations, etc., within the regulated scope.

3. Considering the unique political system of the CCP and the frequent changes in organizational structures and names, to prevent the CCP from intentionally evading our regulations, organizations or groups within the CCP party, military, administrative, or political entities that involve national identity or basic loyalty, engage in cross-strait unification work, or pose a threat to national security or interests are included for comprehensive consideration.

The Mainland Affairs Council emphasizes that due to the CCP’s longstanding attempts to eliminate the sovereignty of the Republic of China and its refusal to renounce the use of force against Taiwan, posing a serious threat to national security and social stability, the Council reminds Taiwanese citizens that there are certain differences in the political and economic systems between the two sides of the strait. Those considering employment in mainland China should carefully assess related risks and adhere to the regulations of the Act Governing Relations between the People of the Taiwan Area and the Mainland Area to avoid taking positions that could jeopardize national security or interests. The Council will continue to make efforts to fulfill its supervisory responsibilities in response to the cross-strait situation, reviewing relevant legal frameworks and making necessary amendments.
