Grandmother of Domestic Violence Victim Collapses in Court as Second Trial Sentenced 16 Times in 2 Years

A woman who suffered domestic violence 16 times in two years had her case re-tried on September 9 in the Wuhou District Court of Chengdu, Sichuan Province. The court rejected the appeal of the defendant, He Moyang, and upheld the original verdict, sentencing him to 11 years in prison for the crimes of intentional injury and abuse.

According to reports from Jímù News and Elephant News, the victim, Ms. Xie, expressed dissatisfaction with the verdict upon leaving the court, believing that the sentence was too lenient. She stated that she would communicate with her lawyer and attempt to apply for a retrial.

Ms. Xie revealed that when she heard that the court upheld the original verdict and the defendant was sentenced to 11 years in prison instead of the death penalty, her grandmother collapsed on the spot and shook uncontrollably. Medical staff from the court immediately assisted her to the medical room for rest, and as of the interview, her grandmother had not left the medical room.

Ms. Xie mentioned that her ex-husband, He Moyang, was also dissatisfied with the verdict. When the court announced the rejection of his appeal and upheld the original judgment, He Moyang (pretending to mishear) repeatedly claimed he couldn’t hear clearly. It was only after the presiding judge said, “The appeal is rejected, and the original verdict is upheld,” and asked if he heard clearly, that he finally admitted to hearing it clearly.

After suffering severe physical injuries from domestic violence, Ms. Xie previously had to wear a colostomy bag. She stated that she no longer needs the colostomy bag, but she now suffers from kidney dysfunction and overall physical weakness.

According to earlier reports from The Paper, since their marriage in May 2021, Ms. Xie had been subjected to 16 instances of varying degrees of domestic violence by He Moyang, requiring multiple hospital visits.

On April 24, 2023, Ms. Xie went to the Wuhou District Court in Chengdu to file for a restraining order and divorce but was unable to complete the procedures due to missing household registration documents. After leaving the court that day, Ms. Xie was followed by He Moyang and forcibly taken to a hotel where she was abused until the next day when hotel workers discovered her and reported to the police.

Medical certificates from the hospital revealed that Ms. Xie had a total of 21 injuries, including extensive lacerations and bleeding in the left liver, duodenal lacerations with rupture, extensive lacerations and excisions in the cecum and sigmoid colon, lacerations in the head of the pancreas and lungs, subarachnoid hemorrhage, brain contusion, acute peritonitis, kidney contusion, deviated nasal septum, three fractured ribs on the left side, and a concussion, among others. Following the incident, He Moyang was criminally detained by the police.

On May 31, 2024, the Wuhou District Court granted the divorce between Ms. Xie and He Moyang, awarding custody of their daughter to Ms. Xie and ordering He Moyang to pay a monthly alimony of 2000 RMB until their daughter reaches the age of eighteen.

On December 27, 2024, the Wuhou District Court sentenced He Moyang to 1 year and 6 months in prison for the crime of abuse and 9 years and 10 months for intentional injury, totaling 11 years of imprisonment. After the first trial verdict, the defendant, He Moyang, immediately expressed his intention to appeal.
