To put a stop to the recurring incidents of gun violence across the United States, on October 9th, Governor Matt Meyer of Delaware signed into law HB123, categorizing the act of shooting at residences, places of worship, vehicles, or establishments as a new criminal offense, classified as a felony of Class E. This measure aims to enhance the safety of families and communities in Delaware, transforming the state into a more secure and compassionate place to reside.
The bill was initiated by Delaware State Representatives Nnamdi Chukwuocha and Senator Darius Brown. Previously, there had been minimal repercussions for perpetrators who fired guns at these locations, despite the psychological and financial harm inflicted on individuals.
Senator Brown stated, “Spaces like homes, churches, and commercial establishments are areas of trust where our neighbors should feel peace rather than fear… The law establishes that shooting in places where Delaware residents should feel secure is a felony, helping to address this harmful gap within the legislative framework.”
The term “establishments” as mentioned in the new law refers to permanent physical structures with signage used for commercial, service, or other lawful activities. “Establishments” do not include shooting ranges or other locations intended for legitimate firearm training or other lawful gun usage.
Representative Chukwuocha emphasized that people should feel safe at home, in church, in their vehicles, and while out shopping. He remarked, “When shooting incidents occur in these areas or their vicinity, regardless of whether someone is hit, the pervading sense of fear in the air is almost palpable. I hope that this new law will bring more peace to our community and ensure that offenders face the appropriate consequences.”
By taking a firm stance against gun violence in specific settings, the state of Delaware aims to curb the prevalence of such incidents and create a safer environment for its residents. The enactment of HB123 reflects a commitment to bolstering community safety and addressing the repercussions of reckless firearm use.
