A delivery driver who worked for liquor stores that fulfilled orders through the Drizly platform can now apply for a $4 million settlement reached between the New York State Attorney General’s Office and the platform. The funds stem from Drizly’s failure to ensure that delivery drivers received their deserved tips, with the deadline for applications set until July 15, 2025.
State Attorney General Letitia James called on all eligible workers on April 23 to promptly submit their applications to receive their rightful compensation, stating, “This will allow delivery drivers who were deprived of income due to Drizly’s misconduct to reclaim their deserved tips.”
In December 2024, the State Attorney General’s Office found that Drizly encouraged customers to tip delivery drivers, leading customers to believe that all tips would be given to the drivers. However, in reality, the tips were collected by the store owners and distributed independently, resulting in some delivery drivers not receiving these tips. Subsequently, the Attorney General’s Office obtained a $4 million settlement from Drizly to compensate the delivery drivers.
The settlement funds will be distributed to delivery drivers who completed deliveries for stores using the Drizly service between January 1, 2018, and August 31, 2023. A third-party organization, Simpluris, has been tasked by the Attorney General’s Office to handle the claims process. Those seeking compensation must submit their applications by July 15 and can do so by visiting the official website link: www.NYDrizlySettlement.com.
The Attorney General’s Office has collaborated with Drizly to compile a list of former delivery drivers who may be eligible for the settlement. Notifications have been sent via mail, email, and text messages since April 7. Individuals who have not received notifications but believe they are eligible can independently submit their applications online.
Furthermore, Letitia James advised delivery drivers to remain vigilant and guard against fraud related to this settlement. Individuals should not disclose personal or financial information to anyone claiming to assist with the application process.
