Chinese Car Blogger Sentenced in First Instance: Ordered to Apologize to Tesla and Compensate 250,000 RMB

On the afternoon of May 30th, Tesla (Beijing) Co., Ltd. and automotive blogger Feng Shiming’s reputation dispute case was heard and ruled upon by the Qingpu District Court in Shanghai. The court ordered Feng Shiming to publicly apologize to Tesla and pay compensation of 250,000 yuan.

At 13:45 on the 30th, Tesla filed a reputation dispute case against Feng Shiming in the first instance at the Qingpu District Court in Shanghai and the judgment was announced. At 13:30 on the same day, Feng Shiming filed a reputation dispute case against Tesla (Beijing) Co., Ltd. and Beijing Weimengchuangke Network Technology Co., Ltd., and the first instance verdict was also rendered in the same court.

According to reports from The Paper, in the case of Feng Shiming v. Tesla regarding reputation rights, the court rejected all his claims. In the case of Tesla v. Feng Shiming regarding reputation rights, the court ruled for Feng Shiming to publicly apologize and pay Tesla 250,000 yuan. Feng Shiming is a certified automotive expert on Weibo.

On April 19, 2021, at the Shanghai Auto Show, Ms. Zhang from Anyang, Henan, and Ms. Li from Xi’an suddenly appeared at the Tesla booth wearing white t-shirts with “Brake Failure.” Ms. Zhang climbed onto the roof of a Tesla, sparking high attention and becoming the most sensational event at the 2021 Shanghai Auto Show.

When Ms. Zhang climbed onto the roof at the auto show, Tesla questioned whether Feng Shiming was the organizer behind the event. Feng Shiming denied this claim on Weibo, stating that he only provided Ms. Zhang with a media pass and that “assisting in legitimate rights protection does not equal organizing climbing onto the roof.”

In 2021, Feng Shiming filed a reputation rights lawsuit against Tesla (Beijing) Co., Ltd. and Beijing Weimengchuangke Network Technology Co., Ltd., with case No. (2021) Hu 0118 Min Chu 14192.

He told The Paper, “I sued Tesla first for publicly defaming me on their official Weibo as the organizer of the auto show incident, leading to intense cyberbullying, personal attacks, and rumors that have persisted until recently.”

At the end of 2021, Tesla filed a reputation rights lawsuit against Feng Shiming for 9 Weibo posts he made, with case No. (2021) Hu 0118 Min Chu 15769.

A screenshot of the judgment shows that the Qingpu Court in Shanghai determined that in the 2021 “Shanghai Auto Show incident,” Feng Shiming did engage in illegal behavior disrupting public order and played an organizing and planning role.

On the afternoon of May 30th, the Qingpu District Court in Shanghai also issued a first-instance judgement in the reputation dispute case filed by Tesla against Ms. Zhang. She was ordered to publicly apologize and compensate Tesla for total losses amounting to 172,275 yuan.
