Recently, Chongqing veteran Ju Xiaolin applied to the Kowloon District Public Security Sub-bureau in Chongqing to hold a rally and procession on Yangjiaping Pedestrian Street on September 25th. However, the Kowloon District Public Security Sub-bureau did not approve the request, citing the reason that Ju Xiaolin had not resided continuously in the city for more than six months.
Ju Xiaolin, a veteran from Fengdu County, Chongqing, submitted an application on September 22nd to hold a rally and procession at the Kowloon Plaza on Yangjiaping Pedestrian Street from 2:00 PM to 4:00 PM on September 25th. The procession was planned as follows: 1. Wearing military uniform; 2. Holding a piece of paper with the word “injustice” written on it; 3. Chanting slogans: Rule of law, oppose the illegal forcible entry of the Kowloon District Public Security Bureau. The procession was planned for 1 person.
On September 23rd, the Kowloon District Public Security Sub-bureau of Chongqing replied that after investigation, Ju Xiaolin’s registered residence is at the Wenhui Village, Group 4, No. 119, Shetan Town, Fengdu County, Chongqing. As of the date of the application submission, he had not resided continuously in the Kowloon District of Chongqing for more than six months. According to Article 15 of the Regulations on Assembly and Procession, citizens are not allowed to organize, participate, or initiate assemblies, processions, or demonstrations in cities other than their place of residence.
Ju Xiaolin told a reporter that, “I think the human rights and freedoms of Chinese people are unsatisfactory! The Constitution sounds good, saying that people have the right to demonstrate, but there are so many restrictions that very little space is left. However, I will continue to fight for my rights tirelessly.”
On the morning of June 9, 2017, police officers from the Kowloon District Public Security Sub-bureau in Chongqing illegally broke into Ju Xiaolin’s rented room at No. 202, Shiqiao Street, Kowloon District, Chongqing, without showing any credentials or legal procedures. Ju Xiaolin, mistaking them for lawless individuals, believed his life was in danger and, to protect his life and property, used gasoline to repel the police officers attempting to enter his room illegally.
As a result of his self-defense actions, Ju Xiaolin was arrested by the Kowloon District Public Security Sub-bureau of Chongqing on charges of “obstructing official duties” and was sentenced to 2 years and 6 months imprisonment by the Banan District Court in Chongqing on the same charge.
Ju Xiaolin said, “I later found out that the group of people were police officers from the Kowloon District Public Security Sub-bureau in Chongqing who were searching for items of a person (Pan Bin) who no longer lived in that house. According to the Criminal Procedure Law, a search warrant must be presented during a search. Since they did not show a search warrant or identify themselves before forcibly breaking into my rented room, they acted illegally and violated the crime of illegal search as stipulated in the Criminal Law. However, these individuals have not faced fair legal consequences for their actions, while I was arrested for obstructing official duties, so I feel that the judicial system is unjust!”
“I am a victim of judicial injustice, and I have known and encountered many innocent people who have been harmed by judicial injustice. The reality tells me that without judicial justice, not only individuals suffer unjustly, but everyone could become a victim, and the country also finds it difficult to achieve long-term stability. Judicial injustice goes against the original intentions of millions of serving military personnel. As a former soldier, my original intent in serving was to defend the country, promote equality, and uphold the rule of law. Therefore, the current judicial injustice has led me to demand to take to the streets.”
Mr. Xue from Chongqing suggested to Ju Xiaolin that he could return to his hometown and apply to hold a similar procession at the production team’s drying dam, following the same format and content. It remains to be seen whether this suggestion would be approved.
